Terms of Service

1. Agreement

These Terms of Service ("Terms") are an agreement between you and the independent individual developer of Eat'Less, based in Romania ("the developer", "I", "me"), for your use of the Eat'Less mobile application ("the App"). By downloading or using the App, you agree to these Terms. If you do not agree, please do not use the App.

2. What the App does

The App lets you log meal times, shows how much time has passed since your last meal, and displays an estimated metabolic phase, estimated satiety, and progress toward a fasting goal you choose.

3. Not medical advice

The App is for general information and personal tracking only. The metabolic phases, satiety percentages, and other values it shows are simplified estimates based only on elapsed time. They are not measurements and are not medical, nutritional, or health advice. The App is not a medical device and does not diagnose, treat, or prevent any condition.

Talk to a doctor or other qualified professional before starting fasting or changing your diet, especially if you are pregnant or breastfeeding, have diabetes or another medical condition, take medication, are under 18, or have a history of eating disorders. Stop fasting and seek medical help if you feel unwell. You use the App at your own risk.

4. License

I grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple devices you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. You may not copy, modify, reverse engineer, redistribute, or resell the App, except where applicable law expressly allows it.

5. Your data

Your meal log is stored only on your device. You are responsible for your device and its backups. Deleting the App deletes its data, and I cannot recover it. The Privacy Policy explains how the App handles information.

6. Availability and changes

I may update, change, or stop offering the App at any time. I do not guarantee that the App will always be available, error-free, or compatible with every device.

7. Disclaimer of warranties

To the extent permitted by law, the App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of fitness for a particular purpose, accuracy, and non-infringement.

8. Limitation of liability

To the extent permitted by law, I am not liable for any indirect, incidental, special, or consequential damages, or for any loss of data or health-related outcomes arising from your use of, or inability to use, the App. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for intent or gross negligence, or your rights as a consumer under mandatory EU and Romanian law.

9. Apple-specific terms

• These Terms are between you and me only, not with Apple Inc. ("Apple"). I, not Apple, am solely responsible for the App and its content.
• Apple has no obligation to provide any maintenance or support for the App.
• If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
• Apple is not responsible for addressing any claims by you or any third party relating to the App, including product liability claims, claims that the App fails to conform to any legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar laws.
• If a third party claims that the App or your use of it infringes their intellectual property rights, I, not Apple, am responsible for the investigation, defense, settlement, and discharge of that claim.
• You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms, and once you accept these Terms, Apple has the right to enforce them against you as a third-party beneficiary.

10. Governing law

These Terms are governed by the laws of Romania. If you are a consumer living in the EU, you also keep the protection of the mandatory laws of your country of residence, and you may bring proceedings in your local courts.

11. Changes to these Terms

I may update these Terms from time to time. The effective date above shows when they were last changed. If you keep using the App after a change, you accept the updated Terms.
